The defendant Kuichi Honmura, and the

defendant Shigeru Imatomi, in conspiracy with Hisaichi

Hamaguchi and without obtaining a permit from the

at

Home Minister, and without having obtained an export permit

from the Customs shipped on the s. s. "Shanghai Maru"

Nagasaki 13 tins (each containing 700 grammes) of

anaesthetic diacetyle morphine hydrochloride, and 5 tins

(each containing 450 grammes) on three occasions during

the period between about April 20th, 1938, and May 21st

1938, and exported them to Shanghai.

No. 4.

The defendant Shigeru Imatomi notwithstanding

that he was not a pharmacist and had no qualification to

sell "specified" drugs, sold 3 tins (each containing

700 grammes) of "specified" drugs, diacetyle morphine

hydrochloride, to Mangaku Fujimura about May 20th, 1938.

The defendant Shunzo Kitagawa;

In selling anaesthetics to shigeru Imatomi

and others knew that they had not obtained a permit from

the Home Minister, and that they intended to export them

to China, and sold 13 tins (each containing 700 grammes)

of anaesthetic diacetyle morphine hydrochloride, and

5 tins (each containing 450 grammes) to them on four

occasions during the period from about April 16th, 1938,

to May 10th, 1938, thereby assisting and facilitating

the offence of smuggling committed by the same person as

stated in No.3.

Notwithstanding that he was not a pharmacist

and was not qualified to sell "specified" drugs sold

3 tins (each containing 700 grammes) of "specified" drugs

of diacetyle morphine hydrochloride to Shigeru Imatomi

at his private house on two occasions; i. e. on the 10th

and 19th of May, 1938.
